Introduction
ShapeDate, LLC, a Tennessee limited liability company, provides a mobile software application that generates projected transformation timelines, personalized workout plans, personalized meal plans, and analytical interpretations of user-submitted data. These Terms of Service constitute a binding agreement between ShapeDate, LLC (“ShapeDate,” “we,” “us”) and the individual using the application (“User,” “you”). By accessing or using the ShapeDate application (“Service”), you agree to these Terms.
Eligibility
The Service requires the User to be at least sixteen (16) years old and legally capable of entering binding agreements. Users between 16 and 18 years old should have parental or guardian consent before using the Service. The Service is not intended for users under sixteen (16) years of age, and ShapeDate does not permit or knowingly collect data from users under sixteen.Account Registration and Security
Users must provide accurate information during account creation. Users are solely responsible for maintaining the security of their devices, Apple ID, HealthKit permissions, login credentials, and any authentication factors. ShapeDate shall not be liable for unauthorized access caused by compromised devices, shared credentials, or disabled security controls.Nature of the Service; No Medical or Professional Advice
The Service generates projected dates on which physical changes may occur, as well as personalized workout plans and personalized meal plans based on User inputs, caloric targets, goals, and selected intensity levels. These outputs are informational only. They do not constitute medical advice, nutritional counseling, personal training, diagnosis, or any health-care service. Users must consult a licensed professional before beginning or modifying diet or exercise activities.Results Disclaimer; No Guarantee of Outcomes
All projections, personalized plans, recommendations, and interpretations generated by the Service are estimates subject to variability in biology, adherence, environment, lifestyle, medical conditions, and accuracy of User-submitted data. ShapeDate makes no warranty and no guarantee regarding physical results, weight change, muscle gain, health outcomes, or achievement of any projected transformation date. ShapeDate disclaims all liability for any failure to achieve expected or projected outcomes. Users assume all risks associated with relying on or acting upon the Service’s outputs.Health and Safety Acknowledgment
Users acknowledge that exercise, dietary changes, caloric modification, and weight-related activities involve inherent risks, including injury or adverse physical events. Users assume full responsibility for determining their own physical capabilities and limitations. ShapeDate shall not be responsible for injuries, medical conditions, or harms arising from the use of personalized workouts, personalized meal plans, transformation projections, or any features of the Service.User Conduct
Users shall not interfere with the operation of the Service, attempt unauthorized access, submit fraudulent data, bypass Apple or system-level security, manipulate system models, or introduce malicious code. Users may not use the Service for unlawful purposes or in violation of these Terms.iOS Permissions and Requirements
The Service may request access to HealthKit data, motion data, notification permissions, and device analytics. Users may deny permissions; however, doing so may limit functionality. All use of system-level data complies with Apple policies and disclosures.Subscription Payments; Pricing
Pricing for subscriptions is determined exclusively within Apple’s App Store platform. Pricing may change at any time and is governed by Apple’s policies. The Service does not control or guarantee pricing, billing cycles, renewals, cancellations, refunds, or payment-processing mechanics. All payment matters, including refunds, must be addressed through Apple. ShapeDate does not store or process payment card information.Intellectual Property
All intellectual property related to the Service, including software, algorithms, models, content, trademarks, workout plans, meal plans, and analytic methods, is owned exclusively by ShapeDate, LLC. Users receive a limited, revocable, non-transferable right to use the Service for personal purposes.Termination
ShapeDate may suspend or terminate a User’s account for violations of these Terms, payment issues, misuse, or violations of Apple App Store policies. Certain data may be retained for legal, audit, and compliance obligations.Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. ShapeDate disclaims all express and implied warranties, including any warranty of accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, or uninterrupted availability. ShapeDate does not guarantee that projections, personalized plans, or recommendations will be accurate or effective.Limitation of Liability
To the maximum extent permitted by law, ShapeDate shall not be liable for any indirect, consequential, incidental, or punitive damages, including loss of health, income, business, opportunity, or data. ShapeDate’s total liability for any claim shall not exceed the total subscription fees paid by the User through the App Store during the twelve (12) months prior to the event giving rise to the claim. Apple shall bear no liability for any matter related to the Service.Indemnification
Users agree to indemnify and hold harmless ShapeDate, LLC, its owners, employees, and affiliates from claims, damages, losses, liabilities, costs, or expenses arising from User’s use of the Service, reliance on projections or personalized plans, submission of inaccurate data, violation of law, or breach of these Terms.Governing Law
These Terms shall be governed exclusively by the laws of the State of Tennessee without regard to conflict-of-law principles.
Entire Agreement These Terms and the Privacy Policy constitute the entire agreement between the parties and supersede all prior understandings regarding the Service.

Introduction
This Privacy Policy describes how ShapeDate, LLC collects, uses, processes, and stores personal data in connection with the ShapeDate mobile application. By using the Service, the User consents to the practices described herein.Data Collected
ShapeDate collects the following categories of data:
Account and Authentication Data: email address, encrypted password, user ID, account creation timestamp, and activity timestamps.
Personal Profile Information: full name, age, biological sex or gender, and height.
Body Metrics and Health Data: starting weight, starting body-fat percentage, updated weight and body-fat entries, goal weight, goal body-fat percentage, check-in history with dates and notes, first weigh-in date, and locked starting statistics.
Fitness Goals and Preferences: stated goals, goal types, goal descriptions, themes, speed preferences, start dates, target transformation dates, and AI-generated interpretations.
Nutritional and Metabolic Calculations: BMR, TDEE, caloric targets, macro distributions, rest/workout day caloric targets, and adjustments.
Food and Dietary Data: meal frequency, dietary preferences, cooking versus eating-out preferences, favorite foods, favorite restaurants, dietary restrictions, foods to avoid, AI-generated exclusions, grocery items with nutritional data, meal rotations, and associated food items and notes.
Workout Data: available equipment, workout programs, exercise details, sets, repetitions, weights, rest times, logs of completed workouts, exercise performance, and training frequency.
Daily Activity and Progress Data: daily logs, caloric adherence, workout completion, weight entries, progress notes, milestones, and timestamps.
AI Interaction Data: messages submitted by the User, responses generated by the AI, conversation identifiers, message counts, timestamps, and metadata.
Device and Technical Data: IP address, device model, operating system version, crash logs, diagnostic data, and analytics identifiers generated by the device or by Apple.
HealthKit Data - ShapeDate may access HealthKit data only if the User provides express permission. HealthKit data is used solely to enhance transformation modeling and personalized plan generation. HealthKit data is not used for advertising, not sold, and not shared with third parties except as permitted for operation of the Service.
Sources of Data - Data is collected directly from the User, from device permissions and sensors, from HealthKit (when authorized), and from AI processing partners when interpreting or generating personalized outputs.
Purpose of Processing
ShapeDate processes personal data for the following purposes:
(a) generating transformation projections;
(b) providing personalized meal plans and personalized workout plans;
(c) enabling progress tracking;
(d) analyzing user inputs;
(e) improving and securing the Service;
(f) complying with legal obligations.Third-Party Processors
- Grok AI (xAI) processes User inputs necessary to generate interpretations, personalized plans, and chat responses.
- Supabase provides authentication, data storage, and real-time synchronization.
- Nutrition databases such as Nutritionix or USDA may be used for data lookup when applicable.
- Apple processes all subscription payments. ShapeDate does not store or process payment card information.
ShapeDate does not sell User data.
Data Security
ShapeDate uses encryption, access controls, Row-Level Security, and secure transmission channels. No system can guarantee complete security.Data Retention
Data is retained for the duration of the User’s account and for a limited period thereafter to satisfy legal, audit, and fraud-prevention obligations. Users may request deletion of their account and data.User Rights
